It would be tough and expensive to present a case where circumcision is deemed medically necessary if the child has no existing medical problems. I can't imagine there is much current legal precedent to rely on. You would have to spend allot of expensive time finding and collating valid medical research. Supporting studies that are the current accepted science would be in thin supply. |

Without making this too boring, it sounds like they now have joint custody, which in Illinois means the residential parent and the non-residential parent have to consult with each other on religion, schooling and major medical decisions. Since they cannot agree, it will come down to whether or not the procedure is medically necessary. The court will find that it cannot prevent the mother from having a medically necessary procedure done. The mother will also ask that the joint custody be dissolved and that she be given sole custody. |
